Separate sealed BIDS will be received for the STORM DRAINAGE CAVE-IN AT RIVERFRONT PARK project by the CITY OF SELMA in the COUNCIL CHAMBERS OF THE SELMA CITY HALL AT 222 NORTH BROAD STREET, SELMA, AL 36701 until 10:00 A.M., C.S.T, Friday, July 10, 2020, and then at said office publicly opened and read aloud.

Printed copies of the BIDDING DOCUMENTS may be obtained at the office of HSA ENGINEERS, INC. located at #1 SATTERFIELD STREET, SELMA, ALABAMA 36702, (334) 875-1960, upon payment of $50.00 for each set.  All BIDDERS submitting a bonafide bid who return Plans and Specifications to ENGINEER, in useable condition, within 10 days of the bid opening will receive a full refund.  Non-bidders will receive no refunds.

The owner reserves the right to waive any informalities or to reject any or all bids.

Each bid must be accompanied by a bid guarantee for an amount not less than five percent (5%) of the total amount of the bid, but not to exceed $50,000.  The bid guarantee may be by certified cashier’s check or bid bond made payable to the City of Selma.

Attention of bidders is particularly called to the requirements as to conditions of employment to be observedand minimum wage rates to be paid under the contract, Section 3, Segregated Facility, Section 109 and E.O. 11246.

No bidder may withdraw its bid within thirty (30) days after the actual date of the opening thereof.

Default having been made in the payment of the indebtednesses secured by that certain Mortgage executed by John B. Hale on the 19th day of April, 2011 to First Cahawba Bank recorded in the Probate Office of Dallas County, Alabama, in RLPY Book 1453 at page 774, et. Seq., First Cahawba Bank, as Mortgagee, by virtue of the power of sale contained in said mortgage, will sell at public outcry, for cash, to the highest bidder, in front of the main entrance of the Courthouse at Selma, Dallas County, Alabama during the legal hours of sale on Thursday, July 23, 2020 all of its right, title and interest in and to the following described real estate situate, lying and being in Selma, Alabama, to-wit:

Lot Four (4) of the Quailes Subdivision as shown by map thereof recorded in Map Book 2, Page 56-B, in the Probate Office of Dallas County, Alabama.

This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the judge of probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties thereto.

Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as a part of the foreclosure process.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.

The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
