Section 1. This act shall apply only in Dallas County.

Section 2. Notwithstanding any law to the contrary, any payment of compensation made in good faith to a judge of probate of Dallas County prior to the effective date of this act is hereby ratified and confirmed, and that judge of probate is authorized to retain any funds received as part of that payment.

Section 3. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.

Final Notice and Public Explanation of a Proposed Activity in a 100-Year/500-year Floodplain and Wetland

To: All interested Federal, State, and Local agencies, Groups and Individuals

This is to give notice that the Dallas County Commission under Part 58 has conducted an evaluation as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 4 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant Program under CDBG CY-CM-PF-19-009. The proposed project is located in the Bogue Chitto Community in unincorporated Dallas County Commission. This project will install water services to homes in areas where floodplains and bottomland hardwood wetlands exist. This project will install approximately 23,000 linear feet of service tubing connecting 99 residences and 2 public buildings to the water mains. This project will take place on existing disturbed areas and there will be no adverse impacts to the floodplains and/or wetlands.  The project will take place on CR 258, CR 49, CR 29, CR 350, CR 375, CR 3, CR 834,CR 894, CR 357,  CR 186, CR 989, CR 351, CR 352, and CR 314. All of these places are in Marion Junction, Alabama and the zip code is 36759.

The Dallas County Commission has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values. The project must take place within an existing floodplain and wetlands because the water main line and home are already exist. The only alternative available is for the for the residents to continue to use shallow wells for potable water. This is not a safe or reliable option, as the wells are no longer function. The project was funded through the Community Development Block Grant Program due to its deplorable conditions and safety concerns. During construction, the Dallas County Commission will utilize all current best management practices to minimize floodplain and wetland impacts. The Dallas County Commission considered applying for a Letter of Map Amendment (LOMA) or Letter of Map Revision (LOMR), however since this floodplain is associated with the creeks and streams of Bogue Chitto; the Dallas County Commission determined the sites would not be eligible for this amendment or revision. This project meets all state and local floodplain protection procedures.

The Dallas County Commission has reevaluated the alternatives to building in the floodplain and wetlands and has determined that it has no practicable alternative.  Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands it must inform those who may be put at greater or continued risk.

Requirements for Bidding: The Selma City Schools shall accept proposals only from Contractors who have successfully completed at least 3 similar projects on time for satisfied State, County or City Governmental Agencies. The lowest bidding Contractor shall submit to the Architect within 24 hours after submitting their bid proposal a listing of projects, construction cost, Owners address and telephone numbers.

A non-mandatory pre-bid conference shall be held on Thursday, March 19, 2020, at 10:30 AM, at Kingston Elementary School, 2224 Selma Ave., Selma, Alabama 36703, Ph: 334.874.1635.

The sealed proposal as described above shall be received by Dr. Avis Williams at the Selma City Schools Office, 2194 Broad Street, Selma, Alabama 36701, until 2:00 PM, Tuesday, March 31, 2020, then opened and read aloud.

All General Contractors bidding this project shall be required to visit the site and examine all existing conditions prior to submitting their proposal. All Bidders shall have general liability and workman’s compensation insurance.

The projects shall be bid excluding taxes. Bids must be submitted on proposal forms furnished by the Architect or copies thereof.  No bid may be withdrawn after scheduled closing for receipt of bids for a period of sixty (60) days.  The Owner reserves the right to reject any or all proposals and to waive technical errors if, in the Owners judgment, the best interests of the Owner will thereby be promoted.

A certified check or Bid Bond payable to Selma City Board of Education in an amount not less than five percent (5%) of the amount of the bid, but in no event more than $10,000.00 must accompany the bidder’s proposal. Performance and statutory labor and material payment bonds will be required at the signing of the Contract.

All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Architect.
